घरेलू हिंसा से लेकर गुजारे भरते के कानूनों के आतंक से लगभग सभी पुरुष व उनके परिवार वाखिफ है। महिलाए बगैर जरुरी दस्तावेज के मुकदमे दर्ज करवा देती है और न्यायधीश बगैर जांच के मुक़दमा दर्ज भी कर लेते है । ये बडा ही दुरभाग्य है कि कोर्ट उच्च न्यायालय के दिशा निर्देश को भी नजर अंदाज कर देते है । अधूरी पिटीशन को भी न्यायलय में चलने दिया जाता है । यही कारण है कि महिलाए धड़ले से कानून से खिलवाड़ करती आई है और बे खोफ करती जा रही है ।
न्यायलय बगैर तथ्यों को देखे हुए, गुजारा भत्ता बांद देती है और सालों मुकदमें चकते रहते है और गुजारा भत्ता मिलने के बाद महिला जान बूझ कर न्यायलय में आना छोड़ देती है।
ऐसे मामलो मे जहां आपको कोर्ट के रिकॉर्ड में महिला के छुपाए दस्तावेज को रिकॉर्ड में लाना हो , तो नीचे दी हुई एप्लीकेशन आप कोर्ट में लगा सकते है । कई हद तक इससे गुजारे भरते को भी रोका जा सकता है । हर मुक़दमा अलग होता है , इसलिए इस तरह की एप्लीकशनलगाने से पहले अपने कानूनी सलाहकार से सलाह जरूर लेले।

URGENT APPLICATION ON BEHALF OF THE RESPONDENT NO.1 REQUESTING TO DIRECT THE PETITIONER NO.1 TO SUBMIT HER SUPPORTING DOCUMENTS OF HER FINANCIAL AFFIDAVIT IN ACCORDANCE WITH THE JUDGMENT OF HON'BLE SUPREME COURT OF INDIA RAJNEESH VS NEHA THAT WAS DIRECTED BY THIS HON'BLE COURT TO THE PETITIONER NO.1 AS PER ORDER DATED / /2022.
MOST RESPECTFULLY SHOWETH:
1.The respondent no.1 here submits that the said case was put up for today the disposal of application for setting aside/modification of interim maintenance of Rs. 30,000/- per month as the petitioner no.1 had gained employment at American Excelsior school and that this Hon'ble court had accordingly directed her to file financial affidavit along with all supporting documents which the petitioner no.1 has failed to comply with till date.
2.Despite directions, the petitioner no.1 has filed an incomplete affidavit without any supporting documents and even despite being asked multiple times by the respondent no.1 and his counsel, the petitioner no.1 has failed to present on record her Credit card statements, Savings Account Bank statements, Her Insurance documents & it’s acknowledgement receipts, 3 years Statement of FORM 26-AS of her PAN Number - **************, 3 years of Income Tax Returns, documents relating to child expenditure and of her assets and liabilities including property/properties and mode of transactions of her current salary credits in her bank account & her updated salary payslips & Salary Certificate of Form 16.
3.The respondent no.1 would like to bring attention of this Hon'ble court to the fact that till date she has not shown any record/records of her salary credits of Rs. 18,000/- and for this, the petitioner no.1 is using unfair means and delaying tactics by deliberately suppressing her documents to delay the trial as much as possible and to harass the respondents. Therefore, till date, the supporting documents of the petitioner no.1 remains deficient that hinders the respondents to proceed with the disposal of their case in this Hon'ble court.
4.That this Hon'ble court was pleased to pass order directing the petitioner no.1 to recover her wedding gifts/articles lying at the residence of the respondents at _________________, New Delhi for which the respondents had no objection and accordingly they had returned all the wedding gifts under the supervision of the protection officer and the local SHO of Police Station-Naraina, New Delhi. However, the said order remains non-complied by petitioner no.1 because no material has ever been put on record by the petitioner no.1 of the said proceedings of recovery despite direction from this Hon'ble court.
5.The respondent no.1 submits here that this Hon'ble court stated in paragraph-9 of the said order that directed the petitioner no.1 that to conduct Videography and Photography of the said proceedings and place on record of the same and the Ld. MM also had directed that a copy be also to be supplied to the respondents. However, the petitioner no.1 till date has not to put the required material on record and has also not shared the same with the respondents of which it has also caused an unprecedented delay for any further proceedings in their case. Therefore, the said order passed on 03-03-2016 till date remains non-complied by the petitioner no.1.
PRAYER
1.That this Hon'ble court may be pleased to direct the petitioner no.1 to file her all supporting documents from the current date of hearing which includes all of her updated Credit card 3 years statements, 3 years statements of her Savings Bank Account, 3 years Statement of FORM 26- AS of her PAN Number - ***********, 3 years of Income Tax Returns, Insurance documents & it’s acknowledgement
receipts, documents relating to child expenditure and of her assets and liabilities including property/properties, mode of payments/transactions of her current salary credits in her bank account & her updated salary payslips & Salary Certificate of Form 16/16A.
2.That this Hon'ble court may pass an order that the respondent no.1 should not be liable to pay any arrears arising out of delay caused on behalf of the petitioner for not submitting her complete set of documents as per directions given in previous order dated___/__/2022 and impose cost and on the petitioner for causing unnecessary delay for timely disposal of this case.
Pass an order which this Hon'ble court may deem fit in the interest of timely Justice.
